1. Who you are contracting with

These Terms govern your access to and use of Mind over Markets (the "Service"), operated by Christopher Goyette & Nolan Pero ("we", "us"). By creating an account or using the Service you agree to these Terms.

2. Eligibility & account

You must be at least 18 years old and of legal age to form a binding contract in your jurisdiction to use the Service. The Service is not intended for and may not be used by anyone under 18. We do not knowingly collect personal information from children under 13. You are responsible for keeping your account credentials confidential and for all activity on your account, and you must provide accurate information and keep it up to date.

3. The Service

Mind over Markets is a trading journal, analytics, community, and Nous coaching product. The Nous coach provides reflective, psychology-focused conversation generated by an AI model. Nous is not a financial adviser and does not provide investment, legal, tax, or trading advice. AI outputs may be inaccurate, incomplete, or out of date, and must not be relied on for trading or investment decisions. You are solely responsible for your own trading, your prompts, and how you use any output.

3a. No earnings or performance claims

We make no representation, guarantee, or warranty that using the Service will result in profitable trading or any specific financial outcome. Trading involves substantial risk of loss. Past performance — yours, ours, or any other trader's — is not indicative of future results. Any examples, screenshots, testimonials, or case studies shown in the Service or in our marketing are illustrative only and are not a promise of similar results.

4. Acceptable use

You will not:

  • use the Service unlawfully, fraudulently, or to send spam;
  • infringe the intellectual property or privacy of others;
  • attempt to interfere with the security of the Service (probing, scraping, malware, reverse engineering, circumvention of technical limits);
  • resell or redistribute the Service or its content without our written consent;
  • use the Nous coach to generate illegal content, hate speech, harassment, or to attempt to jailbreak the model.

5. Intellectual property

We retain all rights, title, and interest in the Service, including its software, documentation, branding, and the model weights and prompts behind Nous. We grant you a limited, non-exclusive, non-transferable right to use the Service per the plan you have purchased. You retain ownership of your own content (journal entries, trades, messages). You grant us a limited license to host and process that content solely to operate the Service.

6. Subscriptions, billing & refunds

Paid plans are billed in advance on a monthly basis until canceled. Payments are processed securely by Stripe. Payment, billing, tax, cancellation and refund mechanics are governed by Stripe's Terms of Service and our Refund Policy.

7. Service level

We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties of merchantability and fitness for a particular purpose.

8. Suspension & termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination you may export your data for a reasonable period before deletion.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where required by law.

10. Indemnity

You will indemnify us against third-party claims arising from your use of the Service in breach of these Terms or applicable law.

11. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email.

12. Governing law

These Terms are governed by the laws of the jurisdiction of Christopher Goyette & Nolan Pero's principal place of business, and disputes will be resolved in its competent courts.
